As an employer, what are the advantages of requiring all of my employees to be seller trained?

Sec. 106.14 (a) of the TABC Code states:
For purposes of this chapter and any other provision of this code relating to the sales, service, dispensing, or delivery of alcoholic beverages to a person who is not a member of a private club on the club premises, a minor, or an intoxicated person or the consumption of alcoholic beverages by a person who is not a member of a private club on the club premises, a minor, or an intoxicated person, the actions of an employee shall not be attributable to the employer if:
  1. the employer requires its employees to attend a commission-approved seller training program;
  2. the employee has actually attended such a training program; and
  3. the employer has not directly or indirectly encouraged the employee to violate such law.
In addition, the employer must abide by the requirements set forth in Chapter 50 of the TABC Rules. This relief is commonly referred to as "safe harbor." If an illegal sale is made, the seller/server will most probably be arrested, but the retailer's permit/license will have protection from administrative action by the TABC

As a retailer, which of my employees must be certified in order to comply with the seller/server requirements?

The definition of an employee is "one who sells, serves, dispenses, or delivers alcoholic beverages under the authority of a license or permit, including persons who immediately manage, direct, supervise, or control the sale or service of alcoholic beverages."

I lost my seller training certification card. How can I obtain another copy?

BE SURE THAT YOUR CERTIFICATION IS STILL VALID. TABC CANNOT REPRINT AN EXPIRED CERTIFICATE.

You may download the "Request for Reprint" form from our forms web page or the Seller Training Division can send you one in the mail or by fax. They will need your Social Security Number and mailing address which you can e-mail to seller.training@tabc.state.tx.us. Please do not e-mail or fax the completed form. We cannot process the form without the $5.00 fee.

Once you receive the "Request for Reprint" form, please read the instructions, complete the form, and return it to Seller Training at the address on the form with a check or money order for $5.00 and a stamped self-addressed envelope.

How do I request a reprint of an employee's certificate?

An establishment can request a reprint, but the employee must sign the request and a notary must witness the employee's signature. The certificate is sent to the employee, but an establishment may submit a written request, with a stamped self-addressed envelope, for a copy of the certificate. The reprint fee is $5.00. The TABC does not have copies of certificates in our offices and a "Request for Reprint" form is required for ordering a reprinted certificate. Allow a couple of weeks for the entire process, which includes mail time and processing time.
